This page is a template provided for general reference only. It is not legal advice, does not create an attorney-client relationship, and must be reviewed and adapted by a licensed attorney in your jurisdiction before use. Recruiters.co makes no representation that this document satisfies any specific legal or regulatory requirement.
1. Purpose & scope
This Marketplace Agreement sets out the participation rules that apply to every account on the Recruiters.co marketplace — recruiters, agencies, and employers alike — in addition to the general Terms of Service. Role-specific obligations are further detailed in the Recruiter Agreement and Employer Agreement.
2. Eligibility & verification
Marketplace access requires an accepted account, and certain marketplace features (such as confidential job orders or verified badges) may require additional organization verification. We may request documentation to confirm identity or business legitimacy before granting expanded access.
3. Marketplace conduct
Participants agree to represent job orders, candidate profiles, and their own qualifications accurately, to communicate professionally with other participants, and not to use the marketplace to solicit activity unrelated to legitimate recruiting collaboration.
4. Confidentiality obligations
Participants must treat confidential employer information, candidate information, and other participants' business terms as confidential, disclosing it only as necessary to perform under a signed split agreement or as required by law.
5. Fees & transaction processing
Subscription fees and placement transaction fees are processed as described in the pricing page and the applicable split agreement for each placement. Transaction fees are deducted at payout; they are never combined with subscription billing into a single undifferentiated charge.
6. Data & candidate ownership rules
Candidate ownership on the marketplace is determined by consent records, submission timing, and any ownership claims filed through the Service. Participants agree to abide by ownership determinations, including outcomes of structured human review for disputed claims.
7. Dispute resolution process
Disputes between marketplace participants regarding a specific placement, split agreement, or candidate ownership claim should first be raised through the in-platform dispute process. Unresolved disputes may be escalated as described in the Terms of Service.
8. Suspension & termination
We may suspend or terminate marketplace access for accounts that violate this Agreement, misrepresent job orders or candidates, attempt to circumvent fees, or otherwise abuse the marketplace.
9. Limitation of liability
Recruiters.co facilitates marketplace transactions but is not a party to the underlying recruiting engagement between participants unless expressly stated. Liability is limited as described in the Terms of Service.
10. Amendments
We may amend this Marketplace Agreement from time to time. Material changes will be reflected in the "Last updated" date above.
