1. Scope of this agreement
This Employer Agreement applies to employer accounts using the Recruiters.co marketplace to post roles and engage recruiters, in addition to the general Marketplace Agreement and Terms of Service.
2. Posting roles & confidentiality
Employers may post job orders as public, confidential, or invite-only. Employers are responsible for the accuracy of role details and for designating the appropriate confidentiality level for sensitive searches, such as replacing an existing employee.
3. Working with recruiters
When an employer grants a recruiter access to a job order, and a candidate is submitted, the terms of that engagement — including fee, split arrangements between recruiters (where applicable), and guarantee terms — are set out in the resulting split agreement or placement agreement.
4. Fees & invoicing
Employers are invoiced the gross placement fee upon a qualifying hire, as defined in the applicable agreement. Employer subscription fees, if any, are billed separately according to the plan selected at recruiters.co/pricing.
5. Placement guarantees
Placements may include a guarantee period during which a replacement search or partial refund is available if the hire does not work out, according to the guarantee schedule specified in the placement agreement (for example, prorated, sliding-scale, or full-refund). Guarantee terms, including the applicable period and schedule, are set out at the time of placement and are not implied beyond what is expressly agreed.
6. Candidate data handling
Employers may only use candidate information received through the marketplace for purposes related to evaluating that candidate for the job order to which they were submitted, consistent with the scope of candidate consent on file.
7. Non-solicitation
Employers agree not to engage a submitted candidate for a role outside the scope of the original submission, or to circumvent agreed fees, without the involved recruiter's knowledge, for a period specified in the applicable placement agreement.
8. Termination
Either party may terminate an employer account as described in the Terms of Service. Termination does not affect fee, guarantee, or confidentiality obligations tied to placements already made.
9. Limitation of liability
Recruiters.co facilitates the marketplace connection between employers and recruiters but is not a party to the underlying employment relationship. Liability is limited as described in the Terms of Service.
10. Governing law
This Agreement is governed by the laws specified in the employer's order form or account agreement, without regard to conflict-of-law principles.
